1. Agreement to Terms

By accessing or using the services provided by On Target Insurance Leads ("Company," "we," "us," or "our") at ontargetinsuranceleads.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. These Terms apply to all agents, subscribers, and visitors who access or use our platform. On Target Insurance Leads is a service of Jzak Associates LLC.

2. Lead Exclusivity

On Target Insurance Leads provides exclusive relocation leads to participating agents. Exclusivity is defined as follows:

• Each lead is sold to one agent only within a defined geographic territory at the time of delivery.
• Territory exclusivity is granted on a first-come, first-served basis upon execution of a subscription agreement.
• Exclusivity applies only to the specific lead type and territory agreed upon in your subscription. Overlapping territories may exist for different lead types.
• On Target Insurance Leads reserves the right to reassign a territory if an agent's subscription lapses, is cancelled, or falls into non-payment for more than 10 business days.
• Leads are generated in real time and delivered as available. We do not guarantee a specific volume of leads per period, though we make commercially reasonable efforts to meet agreed-upon lead volume targets.

3. Payment Terms

By subscribing to our lead services, you agree to the following payment terms:

• Billing cycle: Subscriptions are billed monthly in advance on the date your subscription begins.
• Per-lead billing: If applicable, per-lead charges are invoiced at the end of each billing period based on leads delivered.
• Payment methods: We accept major credit cards and ACH bank transfers. All payments are processed securely.
• Late payments: Accounts more than 10 business days past due may have lead delivery suspended until the balance is resolved.
• Refunds: Leads are non-refundable once delivered. If a lead is determined to be invalid (e.g., incorrect contact information, duplicate), you may request a credit within 5 business days of delivery by contacting [email protected].
• Cancellation: You may cancel your subscription at any time with 30 days' written notice. No partial-month refunds are issued.
• Price changes: We reserve the right to adjust pricing with 30 days' advance notice to your registered email address.

4. Acceptable Use

You agree to use our leads and platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Resell, transfer, or share leads with any third party, including other agents, agencies, or lead aggregators.
• Use leads to contact individuals for any purpose other than offering legitimate insurance products and services.
• Engage in deceptive, misleading, or high-pressure sales tactics when contacting leads.
• Violate any applicable federal, state, or local laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or state-specific insurance solicitation regulations.
• Attempt to reverse-engineer, scrape, or extract data from our platform beyond what is provided through normal use.
• Use automated systems, bots, or scripts to access or interact with our platform.
• Harass, threaten, or abuse any lead contact in any way.

Violation of acceptable use policies may result in immediate termination of your account without refund and may be reported to applicable regulatory authorities.

5. Lead Quality & Disputes

We make commercially reasonable efforts to deliver high-quality, verified relocation leads. However, we do not guarantee that every lead will result in a policy sale. Lead quality disputes must be submitted in writing to [email protected] within 5 business days of lead delivery. Credits for invalid leads are issued at our sole discretion.

6. Intellectual Property

All content, branding, software, and materials on this platform are the property of On Target Insurance Leads and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

7. Limitation of Liability

To the fullest extent permitted by law, On Target Insurance Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, lost leads, or business interruption. Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you in the three months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.

9. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
